SPLUMA - Judgment on the Powers of Development Tribunals
According to the Court “The crux of this appeal is whether a development tribunal retained power, after the suspension period, and therefore at a time when the order of constitutional invalidity was operative, to determine an application lodged with it prior to the expiry of the suspension period”.
The judgment decided that a Tribunal lost the power to consider or decide any application after the expiry of the suspension period (i.e. 17 June 2012). In terms of this judgment no Development Tribunal could have taken any decision in respect of any application on after the 17th of June 2016.
