Terms of Reference for the Building Development Committee

  1. Constitution

The Building Development Committee shall be a committee of The South African Property Owner’s Association, duly constituted in line with the “Articles of Association” of the South African Property Association (SAPOA).

  1. Objective

The objectives of the committee are to:

      • To represent the interests of the members of SAPOA on matters of a material nature relating to building development, and including representations made by the Constituent or other Statutory Bodies.
      • To install and maintain a reference set of, or contact details of the respective source for, common Development Contract Documentation, generally in use in the Construction Industry, including recommended fees scales and professional service level agreements of the built environment professionals.
      • To report to and seek clarity from, the National Council, on matters of concern and to receive consideration from the Building Development committee.
  1. Membership

Members of the committee shall be members of SAPOA and should have a minimum of 10 (ten) members.  

  1. Secretarial and Meetings
  • A quorum of the committee shall be 50% of the members.
  • Reasonable notice of meetings and the business to be conducted shall be given to the members of the committee.
  • Meetings shall be  held not less than 4 (four) times a year. The Chairperson may request a meeting at any time if they consider it necessary.
  • Minutes of all meetings shall be kept.
  1. Responsibilities

The responsibilities of the committee are as follows:

    • liaison with members of SAPOA;
    • To consider issues and concerns brought to its attention by members and, where necessary, to refer such issues and concerns to the respective authority, or to National Council for guidance or attention.
    • To make recommendations and to seek endorsement of form or policy, from the National Council on issues and concerns, discussed within the committee.
    • To report to the National Council on changes and trends, evident within building development projects undertaken by members.

In addition, the committee shall examine any other matters referred to it by SAPOA and SAPOA members.

  1. Authority

The committee is authorized by the chairperson to investigate any activity within its terms of reference.

The committee is not authorized to commit SAPOA to any expense or contract, without the prior approval from the National Council.

  1. Review of the Committee

The Committee shall undertake an annual self review of its objectives and responsibilities.
Such objectives and responsibilities shall also be reviewed by the National Council.  

  1. Reporting Procedures

Liason with the media shall be maintained between the chairperson of the committee and the SAPOA CEO.

The chairperson shall discuss any matter pertaining to media liaison with the SAPOA CEO so as to ensure that SAPOA establishes efficient and clear communication with the media.

The minutes of all Building Development Committee Meetings shall be be circulated to members, the SAPOA Board and the Regional Committees, and, if appropriate, the Chief Executive Officer of SAPOA.
