Terms of Reference for the Government Liaison Committee
- Constitution
The Government Liaison Committee shall be a committee of The South African Property Owner’s Association (SAPOA), duly constituted in terms of the “Articles of Association” of SAPOA.
- Objective
The objective of the committee is to;
- Liaise with and lobby government at all levels in dealing with issues that are of interest or concern to SAPOA members;
- Allow for all other SAPOA committees issues related to government to be forwarded to this committee through the committee representatives and only the Government Liaison committee would liaise or lobby with the government.
- Be a strategic in-house body that will streamline, co-ordinate and carry out liaison and lobbying with government.
- Ensure that all Government issues that arise from the work of this committee shall be a consensus view of SAPOA.
- Be proactive rather than reactive when liaising with or lobbying government.
- Membership
Members of the committee shall be members of SAPOA and shall comprise the Chairpersons of the following SAPOA Committees:
- Property Owners
- Property Managers
- Education
- Regional Councils
- Property Charter
- Facilities and Technical
- Method of Measuring Floor Areas
- Research
- OVS
- Commercial, Industrial and Retail Brokers
- Building Development
- Legal Committee
- SA Council of Shopping Centre
- The Committee may also, from time to time, agree to co-opt persons that can add value to the objectives of the Committee.
- Secretarial and Meetings
- A quorum of the committee shall be 4 (four)members.
- Reasonable notice of meetings and the business to be conducted shall be given to the members of the committee.
- Meetings shall be held not less than 6 (six) times a year. The Chairperson may call ad hoc meeting should circumstances arise where this may be necessary.
- Minutes of all meetings shall be kept.
- Responsibilities
The responsibilities of the committee are as follows:
- Identify government departments that are SAPOA members;
- Keep a good record that informs of the relationships that already exist with the government and SAPOA’s credibility with different levels of government
- Property industry research to inform government
- Identify the applicable government departments and stakeholders, build relationships with these sectors
- Identify which departments are responsible for specific property issues
- Appoint the lobbiest for the to be based in Cape Town.
In addition, the committee shall examine any other matters referred to it by SAPOA and SAPOA members.
- Authority
The committee is authorized by the President of SAPOA to investigate any activity within its terms of reference.
The committee is not authorized to obtain, at the expense of SAPOA, outside legal or other independent professional advice and to arrange for the attendance at meetings, at the expense of SAPOA, of outside parties with relevant experience and expertise if it considers this necessary, without prior approval from the President and the Chief Executive Officer (CEO) of SAPOA.
- Review of the Committee
The Committee shall undertake an annual self review of its objectives and responsibilities.
Such objectives and responsibilities shall also be reviewed by the SAPOA board when appropriate.
- Reporting Procedures
The committee shall maintain direct lines of communication with the SAPOA national Council and SAPOA Board. The chairperson of this committee will be a National Councillor
The Chief Executive Officer and the Chief Financial Officer shall be responsible for drawing to the committee's immediate attention any material matter that relates to the financial condition of the Committee.
After each policy, bill and/or Act review the chairman shall report the committee's position paper and recommendations to the board and the SAPOA Members.
Liason with the media shall be maintained between the chairperson of the committee and the SAPOA CEO.
The chairperson shall discuss any matter pertaining to media liaison with the SAPOA CEO so as to ensure that SAPOA establishes efficient and clear communication with the media.
The minutes of all committee meetings shall be circulated to all members of the committee, the SAPOA Board and the Chief Executive Officer of SAPOA.
